Terms of use

Version 2.0 · Effective 12 October 2026

1. Who we are and what these terms cover

I AM FITNESS is a business name of Axient AI Pty Ltd, ABN 21 688 793 151 ("I AM FITNESS", "we", "us"). Our address is 3/40 Maria St, Petersham NSW 2049, Australia.

These terms apply to the website iamfitness.com.au, the I AM FITNESS web app, the 7-Day POWER Challenge, membership, and everything we publish through them (together, "the service").

You agree to these terms when you create an account, join the challenge or buy a membership. We ask you to confirm this with a tick box, and we record which version you agreed to. Joining the waitlist does not create an account and does not make these terms apply to you; our Privacy Policy and Collection Notice cover the waitlist.

Our Privacy Policy, Collection Notice, Health Disclaimer and Cookies notice form part of these terms.

2. Who can use I AM FITNESS

I AM FITNESS is for adults aged 18 and over. We ask you to confirm your age when you join. If we learn that an account holder is under 18, we close the account and delete the information we hold, as the Privacy Policy describes.

I AM FITNESS is made for women. Anyone aged 18 or over who finds it useful is welcome.

3. What I AM FITNESS is, and is not

I AM FITNESS is general fitness and wellbeing coaching led by Ida Hekate: short video sessions, guided audio, programmes and, from time to time, live classes.

Ida Hekate is a Counsellor, Clinical Hypnotherapist and NLP Master Trainer. She is not a doctor, psychologist or physiotherapist. I AM FITNESS is not medical, physiotherapy, dietetic or psychological treatment, and it does not replace advice from your own health professionals.

When Ida's AI is available in the app, it is always labelled as AI. It is a coaching tool, not a person replying in real time, and it is not a crisis or medical service. If you need support now, call Lifeline on 13 11 14, or 000 in an emergency.

4. Your health and safety

Exercise carries some risk. Before you start, and whenever your health changes, please read our Health Disclaimer. In particular:

If you have an existing injury, disability, medical condition, are pregnant or have recently given birth, please consult your GP, physiotherapist or other qualified health professional before starting, and follow their advice. Stop any exercise that causes pain, dizziness or discomfort.

If you have any injury, get advice from your GP or physiotherapist first, and consult a health practitioner to make sure this is right for you. Stop exercising if anything causes pain or discomfort.

We ask you a short set of health questions before your second challenge day and when you set up a membership. Please answer them honestly and keep them up to date; we use them to offer you lower-impact sessions where that is the safer choice. You are responsible for choosing exercise that is right for you on the day, for your space and equipment, and for stopping when something does not feel right.

Nothing in this section limits the rights described in section 11.

5. Your account

  • You can use an alias. You never need to give us your real name.
  • Keep your sign-in email secure. Anyone who can open that inbox can sign in as you.
  • One account per person. Tell us at support@iamfitness.com.au if you think someone else has used your account.
  • You can change your alias and email, download your data and delete your account from Account → Privacy and data at any time.

6. The 7-Day POWER Challenge

The challenge is free. When you join, you give us your email, an alias and your consent to receive the challenge emails. Day 1 opens straight away; each later day opens at 4 am your local time. Your challenge sessions stay available for 21 days after you join, after which you can restart the challenge or join membership.

Before Day 2 we ask you to complete a short health check (about 90 seconds). If any answer suggests a lower-impact version is the safer choice, we show you that version.

The challenge does not create a paid subscription and does not take any payment details.

7. Membership, prices and billing

Prices. Membership starts with 14 days of full access for $1, then $15 a month or $66 every 6 months unless you cancel. All prices are in Australian dollars and include GST. The $1 is a one-off trial fee: it is charged when you start, is not taken off your first plan payment, and is not refundable except where the law requires. One trial per person.

Payment. Payments are taken by our payment provider, Stripe, using the card, Apple Pay or Google Pay details you give Stripe. We never see or store your card details. Stripe sends your receipts and tax invoices.

Renewal and reminders. Your plan renews automatically at the end of each period until you cancel. Stripe emails you a reminder 7 days before your trial ends and before a 6-month renewal. If a payment fails, Stripe emails you with a link to update your card and retries the payment; your access continues while it retries, and ends only if the payment is not recovered.

Switching, updating and cancelling. Go to Account → Billing to open your secure Stripe billing page. There you can switch between Monthly and 6 months, update your card, download invoices and cancel. Cancelling takes effect at the end of the period you have paid for; during the trial, that means no plan payment is ever taken. We do not charge a cancellation fee, and we do not need a reason.

Refunds. There is no money-back guarantee. We give refunds where the Australian Consumer Law requires it, and we may give one at our discretion. Refunds are processed through Stripe.

Price changes. We will tell you by email at least 30 days before any price change takes effect on your plan. If you do not want the new price, cancel before the change date and you will not be charged it.

Comps and promotions. Any discount, gift or complimentary period is subject to its stated conditions and these terms.

8. Using the service fairly

The service is for your own personal, non-commercial use. Please do not:

  • share your account or sign-in details with anyone else;
  • copy, download, record, screen-capture, stream, resell or redistribute any session, audio, programme, text or image;
  • teach or run classes using our content, or present it as your own;
  • use the service to harass, abuse or harm anyone, including our staff and other members;
  • try to access other people's data, probe our systems, or use bots, scrapers or automated tools on the service;
  • upload anything unlawful, or anything that infringes another person's rights.

We may suspend or close an account that breaks these rules (see section 12).

9. Intellectual property

All videos, audio, programmes, text, images, designs, software and the I AM FITNESS name and marks are owned by, or licensed to, Axient AI Pty Ltd and are protected by copyright and other laws. © 2026 Axient AI Pty Ltd. All rights reserved.

We give you a personal, non-transferable, revocable licence to view and use the content for your own fitness and wellbeing while you have access to it. Nothing else is granted.

Content you upload (for example a progress photo or a note) stays yours. You give us permission to store and show it to you, and to Ida only where you choose to share it, so the service can work.

10. Availability and changes to the service

We work to keep the service available, but we cannot promise it will be uninterrupted or error-free. We may change, add or remove features, sessions and programmes. If we withdraw something that materially reduces what you paid for, we will tell you and you may cancel; where the law requires, we will refund the unused part of a prepaid period.

11. Your rights under Australian law, and our liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded or limited.

To the extent the law allows, and subject to the paragraph above:

  • our liability for any breach of a consumer guarantee in relation to the service is limited, at our option, to supplying the service again or paying the cost of having it supplied again;
  • we are not liable for loss that was not reasonably foreseeable, or that results from your own choices about how, when and where you exercise, including exercising against the advice of a health professional or ignoring the advisories in the app.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for anything else the law says cannot be limited.

12. Ending your account

By you. Delete your account at any time from Account → Privacy and data. Any membership is cancelled at the same time (at the end of the paid period, as in section 7).

By us. We may suspend or close your account if you break section 8, if you are under 18, if we must do so by law, or if we stop providing the service. If we close your account for a reason other than your breach, we refund the unused part of any prepaid period. We will tell you by email, with the reason, unless the law prevents it.

13. Changes to these terms

We may update these terms. Each version has a number and an effective date at the top of this page. For a significant change we will ask you to read and accept the new version in the app before you continue, and we will tell members by email at least 14 days before it takes effect. A change that is only a correction or clarification is recorded but does not need re-acceptance. If you do not accept a change, you can cancel and delete your account.

14. General

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of New South Wales. If any part of these terms is unenforceable, the rest still applies. We may not enforce a term straight away without losing the right to enforce it later. You may not transfer your account or these terms to anyone else.

15. Language

This English version governs. Translations, including browser translations, are for convenience only.
